Terms of Service
Effective date: October 9, 2026
These Terms are a contract between your company and Driftflow LLC, an Ohio limited liability company doing business as CargoConfirm (“CargoConfirm,” “we,” “us”). By creating an account or using CargoConfirm, you agree to these Terms. If you use CargoConfirm for a company, you confirm you can bind it, and “you” means that company.
1. Who can use CargoConfirm
CargoConfirm is for businesses only. You must be at least 18 and use it for business purposes. It is not offered to consumers.
2. What CargoConfirm does
CargoConfirm helps shippers check carriers and document freight pickups. Features may include:
- Carrier lookups using public Federal Motor Carrier Safety Administration (FMCSA) data.
- Carrier monitoring, with alerts when a carrier's authority, insurance, operating status, or contact details change.
- Pickup verification: one-time codes sent to the carrier's email on file with FMCSA, plus checks at your dock (DOT number, code, photos, driver's license scan, GPS location), warnings, holds, and owner approval.
- Release records (PDF), delivery confirmation by your receiver, carrier “we didn't book this load” reports, and theft-report packets.
We may add, change, or remove features. If we remove a major paid feature, we'll tell you in advance.
3. What CargoConfirm does not do
Please read this section carefully.
- No guarantee. CargoConfirm makes your dock a harder target for cargo theft and fraud. It does not prevent all theft or fraud, and we do not guarantee any result.
- You decide. Whether to release freight is always your decision and your staff's. Warnings, holds, and a passed verification are aids, not approvals by us.
- Public data can be wrong. FMCSA and other government data may be incomplete, outdated, or changed by others, including criminals who take over a carrier's registration. We don't verify that data and aren't responsible for its accuracy.
- Email isn't certain. Codes and alerts can be delayed, filtered as spam, or delivered to an inbox someone else controls.
- License scans are records, not identity checks. A barcode can be faked. A scan records what a license says; it does not prove who the driver is.
- We're not your insurer, broker, carrier, or security company, and nothing in CargoConfirm is legal advice. CargoConfirm is not affiliated with FMCSA or the U.S. Department of Transportation.
4. Your account and your staff
- Keep login details secure, and give each staff member their own login. You're responsible for everything done under your account, including by your staff.
- Keep your account information (company name, phone, contact email, locations) accurate. Carriers and receivers see some of it.
- Tell us right away at support@cargoconfirm.com if you suspect unauthorized access.
5. Your responsibilities
You agree to:
- Use CargoConfirm only for pickups you or your company actually arranged.
- Follow all laws that apply to you, including laws on collecting, scanning, and keeping driver information and on recording photos and location, and give any notices or get any consent those laws require.
- Train your dock staff on your release procedures. CargoConfirm supports your procedures; it does not replace them.
- Keep your own copies of records you need for insurance, legal, or business purposes.
You agree not to:
- Use CargoConfirm to harass, track, or contact anyone for any reason other than pickup verification.
- Scrape, copy, resell, or bulk-download carrier data from CargoConfirm, or use it to build a competing database.
- Get around security features, test our systems for weaknesses without our written permission, or access accounts that aren't yours.
- Upload anything unlawful, or anything you don't have the right to share.
6. Messages we send for you
When you create a pickup, we email the carrier's FMCSA-listed address with the code, your company name, the pickup details, and your contact information. If you add a receiver or require owner approval, we email those people too. You authorize us to send these messages for you and confirm you have a real business relationship with the recipients. We send only service messages, never marketing, to people you contact through CargoConfirm.
7. Free trial
New accounts get a 14-day free trial with no card required. When it ends, paid features stop until you subscribe. We may change or end the trial offer for future sign-ups.
8. Plans, billing, and taxes
- Current prices: Monitoring, $99 per month (up to 100 carriers) or $990 per year; Location, $399 per month per active dock location or $3,990 per year. The prices on our website when you subscribe apply.
- Plans renew automatically each month and are charged in advance through our payment processor, Stripe. We never see or store your full card number.
- Adding or archiving a location changes your bill. Stripe prorates charges and credits for changes made partway through a billing period.
- We'll email you at least 30 days before a price increase takes effect.
- Prices don't include taxes. You're responsible for any sales, use, or similar taxes, which we'll add where required.
- If a payment fails, we'll notify you and retry. If it isn't fixed, we may limit or suspend paid features until it is.
9. Cancellation and refunds
You can cancel anytime in Billing. Cancellation takes effect at the end of your current billing period, and you keep access until then. Payments are non-refundable, including for partial months, except where the law requires otherwise.
10. Your data
- You own the information you and your staff put into CargoConfirm, including pickup records and photos (“Your Data”).
- You let us store, process, and display Your Data only to provide, secure, and support CargoConfirm, and as our Privacy Policy describes.
- We may use aggregated information that doesn't identify you, your staff, carriers, or drivers to improve and secure CargoConfirm.
11. Release records and retention
Release records are built from what your staff entered and captured, plus data available at that moment. We don't certify that a record is complete or accurate. We keep Your Data while your account is open and delete it within 90 days after it closes, except copies the law requires us to keep. Download any records you need before closing your account.
12. Feedback
If you send ideas or feature requests, we may use them without any obligation to you.
13. Our property
CargoConfirm, including its software, design, name, and logo, belongs to us. These Terms give you a limited right to use CargoConfirm for your business while your account is in good standing. You may not copy, modify, reverse engineer, or resell it.
14. Other services
CargoConfirm relies on outside services, including FMCSA data, U.S. Census address lookup, Stripe, and our hosting, database, and email providers. We aren't responsible for their outages, errors, or terms.
15. Suspension and termination
- We may suspend or close your account if you break these Terms, don't pay, create a security risk, or use CargoConfirm in a way that could harm others. When reasonable, we'll warn you first.
- You can stop using CargoConfirm anytime and cancel in Billing.
- Sections 3, 9 through 14, and 16 through 21 continue to apply after your account ends.
16. Disclaimer of warranties
CargoConfirm is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't promise CargoConfirm will be uninterrupted, error-free, or secure, or that it will detect every fraudulent carrier, driver, or pickup.
17. Limitation of liability
To the fullest extent the law allows:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or business.
- We are not liable for lost, stolen, damaged, or delayed cargo, the value of any shipment, insurance deductibles or premiums, or any release decision you or your staff make.
- Our total liability for all claims relating to CargoConfirm is limited to the greater of (a) what you paid us in the 12 months before the event that caused the claim, or (b) $100.
These limits apply to every type of claim, even if we were told the damage was possible. They are a core part of our pricing, which is a small fraction of a single load's value.
18. Indemnification
You will defend and cover us, including our members, employees, and contractors, against claims, losses, and costs (including reasonable legal fees) arising from your use of CargoConfirm, your staff's actions, the information you collect or enter (including driver information), your release decisions, or your breaking these Terms or the law.
19. Changes to these Terms
We may update these Terms. For material changes, we'll email account owners at least 30 days before they take effect. Using CargoConfirm after that date means you accept the updated Terms. If you don't agree, cancel before then.
20. Disputes
- Governing law: Ohio law governs these Terms, without regard to conflict-of-law rules.
- Talk first: before filing any claim, email support@cargoconfirm.com and give us 30 days to resolve it informally.
- Courts: any lawsuit must be brought in the state courts in Licking County, Ohio, or the United States District Court for the Southern District of Ohio, and we both consent to those courts.
- Time limit: any claim must be filed within 1 year after it arises, or it's waived.
- No class actions: claims may be brought only individually, not as part of a class or representative action.
21. General terms
- These Terms and our Privacy Policy are the entire agreement about CargoConfirm and replace earlier agreements on the same subject.
- If any part is found unenforceable, the rest stays in effect.
- Not enforcing a part of these Terms isn't a waiver of it.
- You may not transfer these Terms without our written consent. We may transfer them in a merger, acquisition, or sale of assets.
- Neither of us is responsible for delays caused by events beyond reasonable control, such as third-party outages, natural disasters, or government action.
- We'll send notices to your account email.
- We are independent businesses. These Terms don't create a partnership, agency, or employment relationship.
